Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and GroupSkip LLC ("GroupSkip," "we," "us," or "our"). They govern your access to and use of the GroupSkip platform, including the website at groupskip.com, the application at app.groupskip.com, and all related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms in full. If you do not agree, do not use the Service.

1. Eligibility & Account Terms

You must be at least 18 years old and able to form a binding contract under applicable law. By using the Service, you represent that you meet these requirements.

You are responsible for maintaining the security of your account credentials. GroupSkip uses Clerk for authentication. You must not share your login credentials with anyone, and you are responsible for all activity that occurs under your account.

You must provide accurate and complete information when creating your account, including your real name and a valid email address. You agree to update this information promptly if it changes.

You may not create more than one account. If we disable your account, you may not create a new one without our written permission.

2. Permitted Use & FCRA Compliance

GroupSkip is not a consumer reporting agency as defined by the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. ("FCRA"). The Service does not provide "consumer reports" as that term is defined under the FCRA, and no information obtained through the Service may be used as a factor in establishing a consumer's eligibility for credit, insurance, employment, or any other purpose enumerated under Section 604 of the FCRA.

The Service is designed for the following lawful purposes:

  • Locating property owners or their representatives for real estate transactions
  • Skip tracing in connection with lawful debt collection, subject to applicable state and federal regulations
  • Locating individuals for the service of legal process
  • Other lawful, non-FCRA business purposes consistent with these Terms

By using the Service, you certify that you will not use any information obtained through GroupSkip for any purpose covered by the FCRA, including but not limited to making decisions about a consumer's credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living.

3. Acceptable Use Policy

You agree not to use the Service, or any information obtained through the Service, to:

  • Stalk, harass, threaten, or intimidate any person
  • Locate individuals for the purpose of inflicting physical harm
  • Make decisions regarding credit, insurance, employment, housing, or any other eligibility determination governed by the FCRA
  • Investigate or surveil any individual's activities in violation of applicable law
  • Violate the Driver's Privacy Protection Act, 18 U.S.C. § 2721 et seq. ("DPPA"), or any state equivalent
  • Violate the Gramm-Leach-Bliley Act ("GLBA") or any financial privacy regulation
  • Resell, sublicense, redistribute, or otherwise provide GroupSkip data to any third party, whether for free or for compensation
  • Scrape, crawl, or use automated tools to extract data from the Service beyond normal use of the provided interface
  • Circumvent any rate limiting, access controls, or security measures
  • Locate individuals who are the subject of a protective order, restraining order, or who participate in any state or federal address confidentiality program
  • Use the Service in any manner that violates any applicable local, state, federal, or international law or regulation

Telecommunications Compliance. If you use phone numbers obtained through the Service to contact individuals, you are solely responsible for complying with the Telephone Consumer Protection Act ("TCPA"), the Telemarketing Sales Rule, applicable state telemarketing and do-not-call laws, and any other regulations governing telephone communications. GroupSkip does not verify whether phone numbers are on the National Do Not Call Registry or any state do-not-call list. You may not use any auto-dialing system or prerecorded voice message to contact numbers obtained through the Service unless you have independently confirmed that doing so is lawful.

We reserve the right to suspend or terminate your account immediately, without notice, if we have reason to believe you have violated this Acceptable Use Policy. Violations may also be reported to law enforcement.

4. Data Use & Privacy

The data returned by GroupSkip is sourced from third-party consumer data aggregators. We do not independently verify the accuracy, completeness, or timeliness of this data. Search results are provided "as-is" and may contain inaccuracies.

You acknowledge that the information you obtain through the Service may be subject to restrictions under federal and state privacy laws, including the FCRA, DPPA, and applicable state data broker and consumer privacy statutes. It is your sole responsibility to understand and comply with all laws governing your use of this information.

Your use of the Service, including the data you submit (such as names and addresses) and your search history, is governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described in that policy.

We may retain records of your searches and account activity for compliance, security, and legal purposes.

Compliance Verification. We reserve the right to request documentation of your permitted purpose for using the Service at any time. This may include, but is not limited to, a description of your business, the nature of your real estate transactions, or other information reasonably necessary to verify compliance with these Terms and applicable law. Failure to provide requested documentation within 10 business days may result in suspension or termination of your account.

5. Payment Terms

GroupSkip offers three subscription plans, billed monthly:

  • Starter — $99/month (includes 50 group searches, up to 6 people per group, $2.25 per additional search)
  • Professional — $199/month (includes 100 group searches, up to 8 people per group, $2.20 per additional search)
  • Scale — $399/month (includes 200 group searches, up to 10 people per group, $2.15 per additional search)

30-Day Free Trial. New accounts begin with a 30-day free trial period. A valid payment method is required at signup. During the trial, you may use your selected plan's included searches at no charge. Searches exceeding your plan's monthly allowance are charged at your plan's overage rate from your wallet balance. After 30 days, your selected subscription plan activates automatically and billing begins. You may end your trial early and start your paid subscription at any time from the Billing page.

All payments are processed through Stripe. By providing a payment method, you authorize us to charge your payment method for all fees incurred. You are responsible for keeping your payment information current.

Subscription fees are billed in advance at the start of each billing cycle. Overage charges for additional searches beyond your plan's included searches are billed at the end of each billing cycle.

All fees are non-refundable except where required by applicable law. Searches that return no results still count as searches and are billable.

We reserve the right to change our pricing with 30 days' prior notice. Price changes will take effect at the start of your next billing cycle following the notice period.

6. Cancellation & Termination

You may cancel at any time. There are no contracts and no cancellation fees. When you cancel, your subscription will remain active through the end of your current billing period. You will not be charged for subsequent billing cycles.

Upon cancellation, you will lose access to your search history and saved data within the application. However, we retain your data internally for up to 24 months following cancellation. If you reactivate your account within that period, your previous data will be restored. After 24 months, your data may be permanently deleted.

Termination by GroupSkip. We may suspend or terminate your account at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to: violation of these Terms, violation of the Acceptable Use Policy, suspected fraudulent or illegal activity, non-payment, or a request from law enforcement.

Upon termination for cause, you will not be entitled to any refund for the current billing period. We may also retain or delete your data in our sole discretion, subject to applicable legal requirements.

7. Intellectual Property

The Service, including its design, code, connection mapping methodology, algorithms, user interface, and all associated branding and content, is owned by GroupSkip LLC and protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for its intended purpose and in accordance with these Terms. This license does not include the right to modify, distribute, create derivative works from, reverse engineer, or decompile any aspect of the Service.

The data you submit to GroupSkip (such as names and addresses for search) remains yours. You grant us a limited license to process this data solely to provide the Service to you.

Search results generated by the Service are derived from third-party data sources and are subject to those providers' terms. You may use search results only for the permitted purposes described in these Terms. You may not resell, republish, or redistribute search results.

8. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any data returned by the Service will be accurate, complete, or current. You acknowledge that skip tracing data is inherently imperfect and that no search tool can guarantee correct results.

To the maximum extent permitted by law, GroupSkip's total liability to you for all claims arising from or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid to GroupSkip in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).

In no event shall GroupSkip be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, regardless of the theory of liability and even if we have been advised of the possibility of such damages.

You agree to use search results at your own risk. GroupSkip is not responsible for any actions you take based on information obtained through the Service, including any claims arising from contacting or attempting to contact individuals identified in search results.

9. Indemnification

You agree to indemnify, defend, and hold harmless GroupSkip LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

  • Your use of the Service or any data obtained through the Service
  • Your violation of these Terms, including the Acceptable Use Policy
  • Your violation of any applicable law, rule, or regulation, including the FCRA, DPPA, or any state privacy law
  • Any claim by a third party arising from your use of information obtained through the Service
  • Your negligence or willful misconduct

This indemnification obligation survives the termination of your account and these Terms.

10. Dispute Resolution

Governing Law. These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Informal Resolution. Before filing any formal proceeding, you agree to attempt to resolve any dispute informally by contacting us at legal@groupskip.com. We will attempt to resolve the dispute informally within 30 days.

Binding Arbitration. If a dispute cannot be resolved informally, you and GroupSkip agree to resolve it through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. Arbitration will take place in Harris County, Texas, or at another mutually agreed location. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver. You agree to resolve disputes with GroupSkip on an individual basis only. You waive any right to participate in a class action, class-wide arbitration, or any other representative proceeding.

Exceptions. Either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights, or to enforce the Acceptable Use Policy.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through a prominent notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the Service and cancel your account before the changes take effect. Non-material changes (such as formatting, clarification, or typographical corrections) may be made without notice.

12. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and GroupSkip regarding the Service and supersede all prior agreements and understandings.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

Survival. Sections that by their nature should survive termination will survive, including but not limited to: Permitted Use & FCRA Compliance, Acceptable Use Policy, Intellectual Property, Disclaimers & Limitation of Liability, Indemnification, and Dispute Resolution.
